These Terms & Conditions govern your use of Optimum Fishing at optimumfishing.com and the services provided through the website. By creating an account or using Optimum Fishing, you agree to these terms.
1. About Optimum Fishing
Optimum Fishing is a fishing information and intelligence service operated under the trading name Optimum Fishing by a sole trader in England. Contact: support@optimumfishing.com.
2. What the service provides
Optimum Fishing may provide fishing forecasts, weather and environmental information, species-specific recommendations, suggested baits and tactics, saved fishing locations or swims, catch and session logging, and other fishing-related tools.
Information and recommendations are provided to assist anglers and do not guarantee fishing results. Weather, environmental conditions, fish behaviour and third-party information can change or be inaccurate.
3. Accounts
Some features require an Optimum Fishing account. You must provide accurate information when creating an account and take reasonable steps to keep your login details secure. You are responsible for activity carried out using your account. Accounts must not be sold, transferred or used to gain unauthorised access to Optimum Fishing.
4. Children and young people
Users aged 13 or over may create an account. Children under 13 should only use Optimum Fishing with the involvement and consent of a parent or legal guardian. Parents and guardians are encouraged to supervise children's use of the service, particularly when fishing locations or other information about fishing sessions is entered.
5. Saved swims, locations and catch logs
Optimum Fishing may allow users to save fishing locations, swims, catches and session information. These records are intended to remain private to the user's account unless a feature clearly allows the user to choose to share information.
Optimum Fishing may use appropriately anonymised or aggregated information derived from fishing activity to analyse fishing conditions, improve recommendations, develop forecasts and improve the service. Our Privacy Policy explains in more detail how personal information is handled.
6. Fishing and personal safety
Fishing involves inherent risks, including changing weather, deep or moving water, slippery or unstable ground and other environmental hazards. Optimum Fishing forecasts and recommendations are not safety instructions.
Users remain responsible for assessing conditions, following venue rules, obeying applicable laws and fishing regulations, obtaining any licences or permissions required, and deciding whether it is safe to fish. Never rely solely on Optimum Fishing when making a decision concerning personal safety.
7. Free and paid services
Optimum Fishing provides both free and paid access. Paid options may include short-term one-time passes and recurring monthly or yearly memberships.
Prices, access periods and features are shown before purchase. Monthly and Yearly memberships renew automatically until cancelled. Recurring memberships can be managed or cancelled through My account → Manage subscription. Payments are processed by Stripe.
8. Acceptable use
You must not misuse Optimum Fishing, attempt to gain unauthorised access to accounts or systems, deliberately interfere with operation of the service, introduce malicious software, use automated methods to improperly extract data, or use the service for unlawful purposes. We may restrict or suspend access where reasonably necessary to protect users, the service or its systems.
9. Intellectual property
The Optimum Fishing name, website design, original written material, fishing analysis, software and other original content provided through the service may be protected by intellectual-property rights. You may use the service for your personal fishing activities, but you must not reproduce, sell or commercially exploit protected Optimum Fishing material without permission.
10. Third-party information and services
Optimum Fishing may use information or services supplied by third parties, including weather, mapping or environmental-data providers. We cannot guarantee that third-party information will always be available, complete or error-free. Third-party services may also operate under their own terms and privacy policies.
11. Availability and changes
We aim to keep Optimum Fishing available and useful, but continuous or uninterrupted availability cannot be guaranteed. Features may occasionally be changed, updated, suspended or removed, including for maintenance, security or development.
12. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law. Subject to those rights, Optimum Fishing is not responsible for losses resulting solely from a user's decision to rely on a fishing forecast or recommendation where circumstances or conditions have subsequently changed. Nothing in these terms affects your statutory consumer rights.
13. Privacy
Use of personal information is governed by the Optimum Fishing Privacy Policy. This includes information associated with accounts, saved swims and catch/session records.
14. Ending an account
Users may delete their account through My account → Delete my account, or contact support@optimumfishing.com for assistance. Some information may need to be retained where required by law or for legitimate administrative, security or legal purposes, as explained in the Privacy Policy.
15. Changes to these terms
We may update these terms as Optimum Fishing develops. Where a change materially affects users, we will take reasonable steps to make users aware of it. The latest version will be made available through the website.
16. Governing law
These terms are governed by the laws of England and Wales. Nothing in these terms removes any rights a consumer may have to bring proceedings in another UK jurisdiction where applicable consumer law provides that right.
